Terms and Conditions (BidPump)

These Terms and Conditions govern your access to and use of the BidPump website and any enquiries, quotes, bookings, and hire of concrete pump trucks and related services supplied by BidPump (a trading name / business unit of Bidcrete) in Australia.

By accessing this website or engaging BidPump to provide hire services, you agree to these Terms.

1. Definitions

  • BidPump / we / us / our means BidPump (a new arm of Bidcrete) and its related entities, employees, contractors, and agents.
  • Customer / you / your means the business or person requesting a quote, making a booking, or hiring equipment/services.
  • Services means the hire of concrete pump trucks (including operators, where applicable), related equipment, and any ancillary services provided by us.
  • Site means the BidPump website and any pages, forms, or content published on it.
  • Booking means a confirmed request for Services, whether made in writing, by email, phone, or via the Site.

2. Website use (coming soon)

The Site may be used to view information about BidPump and to contact us. The Site is provided on an “as is” basis and may be changed, updated, or withdrawn at any time without notice.

3. Quotes and bookings

  1. Any quote we provide is an invitation to treat only and is subject to:
    • availability of equipment and personnel;
    • site conditions and access requirements;
    • confirmation of scope, timing, and location; and
    • any additional terms set out in the quote or booking confirmation.
  2. Unless otherwise stated, quotes are valid for 14 days from issue.
  3. A Booking is only confirmed when we provide written confirmation (including by email) or otherwise expressly confirm acceptance.

4. Scope of Services and variations

  1. The Services will be performed in accordance with:
    • the agreed Booking/quote; and
    • any reasonable directions required to comply with safety, legal, and site requirements.
  2. If you request changes to the scope, schedule, location, pour size, or other details, additional charges may apply. We may require written confirmation of variations.

5. Customer responsibilities (site readiness)

You must ensure (at your cost) that the worksite is ready for safe and efficient delivery of the Services, including:

  • safe, lawful, and suitable access for pump trucks (including entry/exit, turning, ground bearing capacity, overhead clearance, and traffic management);
  • a safe work environment compliant with applicable WHS requirements;
  • provision of any required permits, approvals, and site inductions;
  • clear instructions regarding delivery location, boom reach requirements, and any restricted operating conditions;
  • suitable washout area and management of concrete waste, unless otherwise agreed; and
  • that concrete supply and other trades are scheduled to avoid delays.

If site conditions are unsafe or unsuitable in our reasonable opinion, we may refuse to commence or may suspend the Services until conditions are rectified. Standby, rescheduling, or call-out fees may apply.

6. Safety and compliance

  1. You must comply with all workplace health and safety laws and site requirements.
  2. We may implement safety measures (including exclusion zones) and may stop work if we reasonably believe there is a safety risk.
  3. We may require evidence of competent supervision and/or traffic management depending on the site.

7. Fees, rates, and payment

  1. Fees are as set out in the quote, rate schedule, or booking confirmation (including minimum hire periods where applicable).
  2. Additional fees may apply for:
    • standby time, delays, washouts, cleaning, or blocked lines;
    • after-hours work, weekends, public holidays;
    • long hose runs, additional labour, or specialised requirements;
    • travel, tolls, ferry costs, or remote locations; and
    • cancellation or rescheduling (see clause 8).
  3. Payment terms will be stated on the invoice unless otherwise agreed in writing. You must pay invoices by the due date.
  4. If you fail to pay on time, we may charge reasonable recovery costs and interest to the extent permitted by law and/or suspend future Services.

8. Cancellations, rescheduling, and standby

  1. You should notify us as soon as possible if you need to cancel or reschedule.
  2. We may charge cancellation or rescheduling fees where:
    • short notice is given; or
    • we have allocated equipment/operators; or
    • the Booking causes us to turn away other work.
  3. Standby time may be charged where delays are caused by site conditions, concrete supply issues, access restrictions, or other factors outside our control.

9. Weather and unforeseen events

We are not responsible for delays or inability to perform Services due to events beyond our reasonable control (including severe weather, road closures, equipment breakdowns, labour shortages, supplier issues, or emergencies). We will use reasonable efforts to minimise disruption and will communicate any changes.

10. Damage, cleaning, and additional costs

  1. You are responsible for costs arising from:
    • unsafe or unsuitable site conditions;
    • blocked lines, contamination, or poor concrete mix/handling outside our control;
    • damage to our equipment caused by your personnel, your contractors, or site conditions; and
    • excessive cleaning or washout not caused by our negligence.
  2. We may charge for repair, replacement, cleaning, downtime, and associated costs to the extent permitted by law.

11. Liability

  1. To the maximum extent permitted by law, we exclude all implied warranties, conditions, and guarantees except those that cannot be excluded under the Australian Consumer Law (ACL) or other applicable laws.
  2. Where our liability cannot be excluded, our liability is limited (at our option) to resupplying the Services or paying the cost of having the Services supplied again, to the extent permitted by law.
  3. To the maximum extent permitted by law, we are not liable for any indirect, consequential, special, or economic loss (including loss of profit, revenue, or opportunity) arising from the Site or Services.
  4. Nothing in these Terms excludes liability for:
    • death or personal injury caused by our negligence;
    • fraud; or
    • any other liability that cannot be excluded by law.

12. Indemnity

You indemnify us against any claim, loss, damage, liability, cost, or expense (including legal costs on a full indemnity basis) arising out of or in connection with:

  • your breach of these Terms;
  • unsafe or non-compliant site conditions;
  • your instructions, directions, or the acts/omissions of your employees, contractors, or agents; or
  • your misuse of the Services,

except to the extent caused by our negligence or breach of law.

13. Intellectual property

All content on the Site (including text, logos, branding, and materials) is owned by us or our licensors and is protected by intellectual property laws. You must not copy, reproduce, or use it except as permitted by law or with our written consent.

14. Privacy

We do not collect sensitive information through the Site.

If you contact us, we may collect basic personal information you provide (such as your name, business name, email address, phone number, and details of your enquiry) for the purpose of responding, providing quotes, and supplying Services.

We handle personal information in accordance with applicable Australian privacy laws. You may contact us to request access to, correction of, or deletion of personal information, subject to legal requirements.

15. Website links and third-party services

The Site may contain links to third-party websites or services. We do not control those sites and are not responsible for their content, availability, or privacy practices.

16. Governing law

These Terms are governed by the laws of Australia and the State/Territory in which BidPump/Bidcrete is based, and you submit to the non-exclusive jurisdiction of the courts in that State/Territory.

17. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on the Site and will apply from the “Last updated” date.
